Terms and Conditions

Last updated: October 27, 2026 · These Terms are an agreement between you and GetPoppy AI Corp ("Poppy AI", "we", "us"), 28 Geary Street Ste 650 Suite 217, San Francisco, CA 94108, United States.

1. Acceptance of Terms

By accessing or using Poppy AI's services, you agree to be bound by these Terms and Conditions.

2. Description of Service

Poppy AI provides AI-powered SaaS solutions. The specific features and functionality may change over time.

3. User Accounts

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

4. User Data

By using our service, you acknowledge and agree that Poppy AI may collect, store, and use your data as described in our Privacy Policy. You grant Poppy AI a license to use your data for purposes including but not limited to providing, improving, and expanding our services.

5. Acceptable Use

You agree not to use Poppy AI for any unlawful purpose or in any way that could damage, disable, overburden, or impair our service.

6. Intellectual Property

The Poppy AI service, including all associated intellectual property rights, belongs to us. You may not copy, modify, or create derivative works of Poppy AI or its content.

7. Termination

We reserve the right to terminate or suspend access to our service immediately, without prior notice or liability, for any reason. If we terminate your subscription for reasons other than your breach of these Terms (including our Code of Conduct), we will refund the unused portion of your prepaid subscription on a pro-rata basis.

8. Limitation of Liability

To the maximum extent permitted by law, Poppy AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the service.

9. Subscriptions, Renewals, Refunds, and Cancellation

Automatic renewal. Poppy AI subscriptions renew automatically at the end of each billing period (annually for annual plans, monthly for monthly plans) until you cancel. By subscribing, you authorize us to store your payment method and charge it at each renewal at your renewal price: the plan price shown at checkout, not the $1 trial fee and not any one-time discount on your first payment (see the Subscription Terms).

Trials. The $1 trial lasts 7 days. Unless you cancel before it ends, it converts automatically to your paid plan at the price shown at checkout (currently $399/year) and renews every year after that until you cancel. The conversion payment is non-refundable, except where required by law. Each customer can use one trial. See the Refund Policy for details.

30 day money back guarantee. Your first plan payment is covered by a 30 day money back guarantee, subject to the conditions in our Refund Policy (including attending an onboarding call). It does not cover trial conversions, renewals, or upgrades, including lifetime upgrades and credits. Refunds are governed by our Refund Policy, which forms part of these Terms.

Renewals are non-refundable. Renewal payments are non-refundable except where required by applicable law. We email a reminder before each annual renewal listing the renewal date, the price, and how to cancel. If you do not wish to renew, cancel before your renewal date. Forgetting to cancel a trial or a renewal is not a billing error and does not qualify for a refund. Upon cancellation you keep full access until the end of the billing period you have paid for.

How to cancel. You can cancel anytime: click your profile picture in the app, then Billing, and manage your subscription in the billing portal. You can also contact support at support@getpoppy.ai or via the support chat. If you paid through Whop or ThriveCart, you can also cancel from that platform's account page, or ask us to cancel it for you.

Upgrades, credits and other purchases. Upgrades and add-ons, including lifetime upgrades, credits and the Viral Content Academy, are non-refundable, whether you buy them during a trial or after your first plan payment (we incur AI costs on your behalf as soon as credits are issued). See the Refund Policy and Subscription Terms for complete details.

Payment disputes. If you believe a charge is wrong, contact support@getpoppy.ai first. We refund billing errors in full; see section 5 of our Refund Policy.

Statutory rights. Nothing in this section limits any non-waivable rights you have under the laws of your place of residence (for example the 14 day withdrawal right for EU and UK consumers).

10. Product Delivery

The product is always delivered immediately after purchase. Your account is active as soon as payment is complete. The onboarding call is a separate session; attending it is a condition of the 30 day money back guarantee described in our Refund Policy. If users experience any technical issues accessing the platform, they should contact customer support for assistance.

11. Changes to Terms

We reserve the right to modify these terms at any time. It is your responsibility to check these terms periodically for changes. The version in effect on the date of a purchase governs that purchase; for a trial, that is the day you started the trial. Earlier versions: August 5, 2026.

12. Governing Law and Dispute Resolution

These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Venue for any permitted court proceedings is San Francisco County, California.

Arbitration and class action waiver. Except for small claims and where prohibited by law, any dispute arising out of or relating to these Terms or the service will be resolved by binding individual arbitration administered by a recognized arbitration provider under its consumer rules. You and Poppy AI each waive the right to a jury trial and agree that disputes will be brought only on an individual basis, not as a class, collective, or representative action. You may opt out of this arbitration provision within 30 days of first accepting these Terms by emailing support@getpoppy.ai with the subject "Arbitration Opt Out". This section does not limit non-waivable consumer rights.

13. Code of Conduct and Service Termination

At Poppy AI, we maintain a respectful environment for both our customers and our team. By using our service, you agree to:

We reserve the absolute right to terminate or suspend service immediately, at our sole discretion, for any user who violates these conduct standards. This termination right exists independently of any other rights or remedies available to us under these Terms or applicable law. Decisions regarding termination for conduct violations are final.

14. Disclaimers

Poppy AI makes no express or implied warranties or representations with respect to the product Poppy AI. We make no representation that the operation of the Poppy AI website or services will be uninterrupted or error-free, and we will not be liable for any consequences arising from any interruptions or errors.
